AN OPEN LETTER TO THE INDEPENDENT NATIONAL ELECTORAL COMMISSION (INEC)

Warri Federal Constituency Demands Action: Release Fieldwork Report Now and Begin New Voter Registration!

‎Dear Sir,

‎We, write to you as concerned citizens and stakeholders in the democratic future of Nigeria, particularly with respect to Delta State and the Warri Federal Constituency.

‎This letter is necessitated by the imperative to uphold the rule of law and democratic integrity through the immediate and full implementation of the Supreme Court’s judgment delivered on December 2, 2022, in the case of Hon. George Timinimi & Others v. INEC (Suit No: SC.413/2016).

‎In its unequivocal decision, the apex court ordered INEC to undertake a comprehensive delineation of electoral wards and polling units, along with fresh voter registration within the Warri Federal Constituency, comprising Warri North, Warri South and Warri South West Local Government Areas. Critically, the Court stipulated that no further electoral activities should take place in the constituency until these directives are fully executed.

‎The continued delay in this regard threatens not only to undermine the Supreme Court’s binding judgment but also to erode the credibility of INEC and the integrity of any future elections in the Warri Federal Constituency.

‎Legal Consequences of Further Delay and Non Implementation.

‎It must be clearly stated that any electoral activity carried out in the Warri Federal Constituency, including continuous voter registration or election conduct prior to the full execution of the Supreme Court’s judgement would be illegal, unconstitutional and ultimately null and void. Such action would amount to the disenfranchisement of eligible voters, as there currently exist no lawful ward structure, polling unit framework, or valid voters register in the Warri Federal Constituency.

‎Conclusion

‎With the 2027 general elections rapidly approaching, the urgency of this matter cannot be overstated. To proceed with any electoral processes in defiance of the Supreme Court’s judgment would constitute a grave violation of the Constitution and a flagrant disregard for judicial authority. Furthermore, any deviation from the established field report could provoke electoral unrest, encourage malpractice and severely diminish public confidence in the electoral system.

‎We, therefore call upon INEC to act swiftly, decisively and in full accordance with the law by implementing the delineation field report without further delay. This is not merely a legal obligation, it is a moral and democratic imperative. The people of Warri Federal Constituency deserve to vote and be voted for in the forthcoming general elections.
