Warri Ijaw Stakeholders Warns Of Legal Actions, Electoral Consequences Over INEC’s Refusal To Implement, Announce Warri Federal Constituency Delineation Report Ahead Of 2027 Elections. -

The Warri Ijaw Stakeholders have expressed grave concern over the continued refusal of the Independent National Electoral Commission (INEC) to announce and implement the Warri Federal Constituency wards and polling units delineation exercise report, despite a binding order of the Supreme Court of Nigeria.

The stakeholders state that INEC’s failure to comply with the apex court’s judgment poses serious legal, constitutional, and electoral risks ahead of the 2027 General Elections.

Legal Position
By virtue of Section 287(1) of the 1999 Constitution of the Federal Republic of Nigeria (as amended), the decisions of the Supreme Court are final and binding on all authorities and persons, including INEC. Any refusal, delay, or selective compliance constitutes a violation of the Constitution and amounts to contempt of court.

Additionally, Sections 14(2)(a), 14(2)(c), and 42 of the Constitution guarantee equity, fairness, and freedom from discrimination in political representation.

The non-implementation of the delineation report undermines these constitutional guarantees and denies affected communities equal participation in the democratic process.

Electoral and Democratic Implications.

The Warri Ijaw Stakeholders caution that conducting the 2027 elections without implementing the court-ordered delineation will: Expose the elections to legal challenges and post-election litigation;
Risk voter disenfranchisement and unequal representation;
Undermine the credibility and legitimacy of election outcomes; Heighten political tension and erode public confidence in democratic institutions.

Any election conducted in defiance of a subsisting Supreme Court judgment may be declared invalid by the courts.

Formal Demand and Notice.

The Warri Ijaw Stakeholders hereby issue a formal demand and legal notice to INEC to immediately announce and implement the Warri Federal Constituency wards and polling units delineation exercise report in full compliance with the Supreme Court judgment.

Failure to do so will compel affected stakeholders to explore all lawful remedies available under the Constitution to protect their rights and preserve the sanctity of Nigeria’s electoral process.

Call to Stakeholders.

The group calls on civil society organizations, the National Assembly, political parties, and the international community to take note of this constitutional breach and urge INEC to uphold the rule of law in the interest of peaceful, credible, and inclusive elections in 2027.
